Rental terms
This page summarizes, in plain language, the Maison Automobile rental contract. The full contract is provided and explained before signing; in case of any discrepancy, it prevails.
Eligibility
To rent a vehicle, you must be at least 21 years old and hold a valid driver's licence (class 5 or equivalent) for at least 2 years. The information provided on the contract must be accurate.
Required documents
A valid driver's licence (class 5 or equivalent) and a piece of ID. The information needed for payment and the security deposit is collected when the rental is confirmed. Our team walks you through it with your request.
Deposit and payment
The rental rate, included mileage, the rate for additional mileage, and the payment method are set out in the contract before signing. GST and QST are added to the amounts shown.
No interest is charged on the rental price: amounts owed correspond only to the rental price, actual costs incurred, and the amounts provided for in the contract.
The security deposit amount is set according to the vehicle and shown in the contract. It is collected, as agreed with you, either as a credit-card pre-authorization (amount held, not charged) or as a charged, refundable amount. The details are set out in a separately signed pre-authorization agreement.
The deposit covers only amounts actually owed under the contract: damage up to the deductible, missing fuel, cleaning, excess mileage, fines, and late fees. No interest or penalty is charged beyond these actual amounts.
The balance is returned, or the pre-authorization released, within 7 business days of the vehicle's return and final inspection, with a breakdown of any amount withheld.
Insurance
Every vehicle is covered by a commercial auto insurance policy authorizing short-term rental. This coverage is verified before each rental.
In the event of damage to the vehicle during the rental, your liability is limited to the $3,000 deductible, which may be withheld from the security deposit. Beyond the deductible, you remain liable for damage resulting from unauthorized use or an insurance exclusion arising from your actions.
In the event of a claim, you agree to fully cooperate and provide the required information and documents without delay.
Drivers
Only the renter and any additional drivers expressly listed on the contract, meeting the same eligibility conditions, are authorized to drive the vehicle.
Use of the vehicle
The vehicle is rented for strictly personal use, to be driven carefully and diligently in accordance with the Highway Safety Code. In particular, it is prohibited to:
- sublet the vehicle or use it for paid transport of people or goods;
- drive while impaired by alcohol or drugs;
- take part in races, competitions, or speed trials;
- use the vehicle off-road, for towing, or with an excessive load;
- take the vehicle outside Québec and Ontario without prior written authorization (you may travel freely throughout Québec and Ontario);
- allow the vehicle to be driven by an unauthorized person;
- use the vehicle for any unlawful purpose.
The vehicle is handed over with a fuel level recorded on the contract and must be returned at the same level. Otherwise, missing fuel is billed at actual cost, plus reasonable service fees corresponding to costs incurred. Included mileage and the rate for additional mileage are shown in the contract; any excess is billed at the agreed rate.
Report any breakdown, mechanical warning, or incident without delay. No repair may be undertaken without Maison Automobile's authorization. In the event of an accident, notify our team immediately, contact emergency services and the police if the situation requires it, then complete an accident report and collect the contact information of the parties and witnesses involved.
Fines, tickets, offences, and toll charges incurred during the rental are your responsibility. These amounts, along with actual administrative processing fees, may be withheld from the security deposit or billed separately.
Cancellation and changes
Your request commits you to nothing until the rental is confirmed — just write to us to adjust or cancel it.
Once confirmed, any extension must be agreed on in writing before the due date. Otherwise, each period of delay is billed at the applicable rental rate, prorated, until the vehicle is actually returned, with no interest or penalty beyond actual losses.
Pickup and return
The rental begins and ends at the dates, times, and locations agreed on in the contract. The vehicle must be returned no later than the scheduled date and time, in the same condition as at pickup (normal wear excepted), clean, and with the same fuel level.
The vehicle's condition, odometer reading, and fuel level are recorded together at pickup and again at return. Cleaning fees, damage, or excess mileage found are charged at actual cost or according to the amounts provided for in the contract.
Personal information
The personal information collected is used solely to manage the rental, for billing, and to comply with legal obligations. It is kept secure and is disclosed only to authorized persons or when required by law, in accordance with Québec legislation and our privacy policy.
Governing law
The contract is governed by the laws in force in the province of Québec. Any dispute falls under the jurisdiction of the courts of the judicial district of Montréal; the parties agree to first attempt an amicable settlement. You do not waive any rights granted to you by law.
